Void vs. Voidable: How California Classifies Invalid Marriages

California law draws a firm line between two categories of invalid marriage. Understanding which one applies determines your options and your deadlines.

Void Marriages

Some marriages are invalid from the moment they occur, regardless of whether a court ever says so. Under California Family Code Section 2200, a marriage between close blood relatives (parents and children, siblings, or aunts/uncles and nieces/nephews) is void as incestuous. Under Family Code Section 2201, a marriage is void for bigamy if either party was already legally married to someone else at the time. Because void marriages never had legal standing, there’s no filing deadline to ask a court to formally declare them invalid, though a court judgment makes that invalidity official on the record.

Voidable Marriages

A voidable marriage is legally valid until a court annuls it. California Family Code Section 2210 lists the recognized grounds: a party was underage and lacked required parental or court consent; one party had a prior existing marriage or domestic partnership; either party lacked the mental capacity to consent; the marriage was obtained through fraud or force; or one party has an incurable physical incapacity to consummate the marriage. Without a court judgment, a voidable marriage remains in effect.

Filing Deadlines by Annulment Ground

Most voidable grounds carry a statute of limitations. Miss it and the right to annul on that ground may be gone.

• Underage marriage: The minor generally has four years after turning 18 to file; a parent or guardian may file any time before the minor reaches the age of consent.
• Prior existing marriage: Either party to the current marriage may file as long as both are alive; the prior spouse may also bring the action.
• Unsound mind: The affected party, a relative, or a conservator may file at any time before either party dies.
• Fraud or force: Generally four years from the date of marriage or from discovering the fraud. A deceived spouse who later freely continues the marriage after learning the truth can lose this ground entirely.
• Void marriages (bigamy, incest): No deadline applies because the marriage was never legally valid.

Property, Support, & Custody After a Judgment of Nullity

Because an annulled marriage is treated as if it never legally existed, there’s generally no community property to divide. That changes when the putative spouse doctrine applies. If a spouse reasonably and in good faith believed the marriage was valid, a court can recognize them as a putative spouse and divide quasi-marital property and award support accordingly.

Child Custody & Support

Children are a separate matter entirely. Custody and support decisions in an annulment case follow the same best-interest-of-the-child standards used in every California divorce. A child’s rights don’t depend on whether the marriage itself was valid.
